Terms of Service

1. Acceptance of Terms

By creating an account or using BlackieShield services ("the Service"), you agree to be bound by these Terms of Service. If you do not agree, do not use the Service.

2. Service Description

BlackieShield provides HTTP/SOCKS5 proxy and WireGuard VPN services on a subscription basis. A single subscription grants access to both proxy and VPN services, but only one service may be active at a time per account.

3. Account Registration and Authentication

3.1 Account Creation

You must provide accurate registration information.
You are responsible for maintaining the confidentiality of your credentials.
You must be at least 18 years old to create an account.
Each account is for a single user. Account sharing is prohibited.

3.2 Third-Party Authentication (Google Sign-In)

You may create an account or sign in using your Google account via Google Sign-In. By choosing to authenticate with Google, you agree to the following:

BlackieShield will receive your name, email address, and profile picture from Google.
Your Google account credentials (password) are never shared with or stored by BlackieShield.
If you sign in with Google using an email address that matches an existing BlackieShield account, the accounts will be automatically linked.
You may unlink your Google account at any time by setting a password through your account settings, after which you can use email/password authentication independently.
BlackieShield's use and transfer of information received from Google APIs adheres to the Google API Services User Data Policy, including the Limited Use requirements.

3.3 Account Security

You are responsible for all activity that occurs under your account.
Notify us immediately if you suspect unauthorized access to your account.
We reserve the right to suspend accounts that show signs of compromise.

4. Acceptable Use Policy

You agree not to use the Service for:

Any activity that violates applicable laws or regulations
Distributing malware, viruses, or other harmful content
Sending spam or unsolicited communications
Attempting to gain unauthorized access to any system or network
Distributing copyrighted material without authorization
Activities that threaten the safety or well-being of others
Mining cryptocurrency or running servers through the proxy/VPN
Excessive automated requests (scraping) that degrade service quality
Reselling or redistributing access to the Service

5. Subscription and Billing

Subscriptions are billed monthly or annually as selected.
Payments are processed via PayPal or other supported payment providers.
Subscriptions auto-renew unless cancelled at least 24 hours before renewal.
Refunds are available within 7 days of initial purchase if less than 1 GB of data has been used.
Plan upgrades take effect immediately; downgrades take effect at the next billing cycle.
Unused data quotas do not roll over between billing periods.

6. Service Limitations

Only one service (proxy OR VPN) may be active at a time.
Bandwidth and data quotas vary by plan and are enforced automatically.
We reserve the right to implement fair-use limits to maintain service quality.
Service availability is provided on a best-effort basis; we target 99.9% uptime.

7. Service Switching

When switching between proxy and VPN services, the currently active service will be disconnected before the new service is activated. Some plans include a cooldown period between switches to prevent abuse.

8. Intellectual Property

The BlackieShield name, logo, and all related trademarks, service marks, and trade dress are the property of BlackieShield. You may not use our intellectual property without prior written consent.

9. Termination

You may cancel your subscription and delete your account at any time.
We may suspend or terminate your account for violation of these Terms.
Upon termination, all data will be deleted in accordance with our Privacy Policy.
No refunds will be issued for accounts terminated due to Terms violations.

10. Disclaimer of Warranties

The Service is provided "as is" and "as available" without warranty of any kind, express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, and non-infringement.

11. Limitation of Liability

BlackieShield shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Service, including but not limited to loss of data, loss of profits, or interruption of service. Our total aggregate liability is limited to the amount paid by you in the 12 months preceding the claim.

12. Indemnification

You agree to indemnify and hold harmless BlackieShield, its officers, directors, employees, and agents from any claims, damages, losses, or expenses (including reasonable legal fees) arising from your use of the Service or your violation of these Terms.

13. Modifications

We may modify these Terms at any time. Material changes will be communicated via email at least 30 days in advance. Continued use of the Service after changes take effect constitutes acceptance of the new Terms.

14. Governing Law

These Terms shall be governed by and construed in accordance with applicable law. Any disputes shall be resolved through binding arbitration.

15. Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in full force and effect.
